1 Acceptance of Terms

By purchasing, downloading, installing, or using LottoAxe OS firmware ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the Software.

2 License & Open Source

LottoAxe OS firmware contains GPL-3.0 licensed components derived from ESP-Miner/AxeOS. The corresponding source code is available at github.com/lottoaxe/lottoaxe-os-gpl-source. GPL-covered components are subject to the terms of the GNU General Public License v3.0.

Your purchase provides:

• Pre-compiled firmware binaries ready to flash.
• Access to the customer download portal and update delivery system.
• A unique license key for authenticating with the download portal.
• Future compiled firmware updates at no additional cost.

Commercial services including compiled binary distribution, the download portal, update delivery, customer support, and the LottoAxe OS website are proprietary and are not covered by the GPL.

3 License Key & Download Portal

Each purchase generates a unique license key tied to your account. This key grants access to the customer download portal and compiled firmware updates.

• Your license key is non-transferable and may not be shared, posted publicly, or distributed to any third party.
• All license key verifications are monitored and logged, including IP address, device information, and timestamp.
• If a license key is found to be in use across multiple unrelated IP addresses, geographic locations, or devices inconsistent with personal use, the key may be flagged for review.
• Keys confirmed to be shared or distributed may be revoked without refund at our sole discretion.
• The license key system controls access to our commercial download portal and update services. It does not restrict rights granted under the GPL-3.0 license for GPL-covered source code components.

4 Disclaimer of Warranties

We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components. We do not warrant that the Software will meet your requirements or expectations. We do not warrant any specific mining performance, hashrate, efficiency, or profitability.

5 Limitation of Liability

• Damage to or destruction of mining hardware (including but not limited to ASIC chips, power supplies, fans, circuit boards, or enclosures)
• Loss of cryptocurrency, mining rewards, or digital assets
• Loss of profits, revenue, data, or business opportunities
• Hardware overheating, fire, electrical damage, or any physical harm
• Loss of mining uptime or pool connectivity
• Any damages arising from the use of experimental, aggressive, or overclocked tuning presets

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE ($15 USD). This limitation applies regardless of the legal theory upon which the claim is based.

6 Hardware Risk Acknowledgment

By using this Software, you acknowledge and accept the following:

• Cryptocurrency mining hardware operates under significant thermal and electrical stress.
• Custom firmware may push hardware beyond manufacturer-specified operating parameters.
• Overclocking, voltage modification, and aggressive tuning presets (including "Lotto Mode" and "YOLO OC") carry inherent risk of hardware damage or failure.
• Thermal safety features (throttling and shutdown) are provided as safeguards but are not guaranteed to prevent all damage in all conditions.
• You are solely responsible for monitoring your hardware's operating conditions and ensuring adequate cooling and power supply.
• Use of any tuning preset beyond "Safe" rated modes is entirely at your own risk.

7 Mining & Financial Disclaimer

LottoAxe OS is a firmware tool. It is not financial advice, an investment product, or a guarantee of mining profitability.

• Solo mining is inherently probabilistic. There is no guarantee you will ever mine a block or receive any rewards.
• Cryptocurrency values are volatile and can decrease to zero.
• Mining difficulty changes over time and may affect your results.
• Pool configurations provided as defaults are for convenience only. We are not affiliated with any mining pool and make no guarantees about pool reliability or payout.
• You are responsible for your own wallet security and pool configuration.

8 Refund Policy

Due to the digital nature of firmware, all sales are generally considered final. Refund requests will be considered on a case-by-case basis at our sole discretion. To request a refund, contact us within 7 days of purchase with your order details and reason for the request.

9 Updates & Modifications

We may release updates to the Software from time to time. Updates are provided at our discretion and are not guaranteed. We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the revised Terms.

10 Indemnification

You agree to indemnify, defend, and hold harmless LottoAxe OS, its developers, contributors, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Software, your violation of these Terms, or your violation of any applicable law.

11 Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13 Entire Agreement

These Terms constitute the entire agreement between you and LottoAxe OS regarding the use of the Software. They supersede all prior and contemporaneous understandings, agreements, and communications, whether written or oral.
